An article published on the online version of the Spanish business newspaper Expansión (see article in Spanish here) reports about Iberdrola informing the competition services of the EU Commission about what it perceives as unfair practices by Enel for breaching market rules by heavily relying on the support of the Italian state in the takeover bids “war” unfolding in Brazil.

Where these are indeed unfair competition practices, the relevant Brazilian regulations should apply; whereas it will constitute state aid where it has impact on cross-border economic activity inside the Community, and thus patterns of trade between Member States, are capable of being affected.
